Bis 18. Februar erbitten sich die Höchstrichter Auskünfte auf die insgesamt zehn Fragenkomplexe, die am 26. Jänner an das Gesundheitsministerium sowie dessen Rechtsvertreter ergingen. Beim VfGH waren etliche Beschwerden gegen die Verordnungen eingelangt, die unter anderem Lockdown und 2-G- bzw. 3-G-Regel zur Folge hatten.
Fragen zu Überlastung der Spitäler und Verstorbenen
Den VfGH interessiert, ob jemals eine Überlastung des Gesundheitssystems gedroht habe – ein Szenario, das laut Gesetz erst einen Lockdown rechtfertigt. Die Frage: „Der Verfassungsgerichtshof ersucht daher um Auskunft, ob die in den Verordnungsakten angegebenen Hospitalisierungs- bzw. Verstorbenenzahlen alle mit SARS-CoV-2 infizierten Personen, die in Spitälern auf Normal- oder Intensivstationen untergebracht sind bzw. die ‚an oder mit‘ SARS-CoV-2 verstorben sind, umfassen? Wenn ja, warum wird diese Zählweise gewählt?“ Debatte Omikron: Welche Strategie ist angemessen?
In dieser Tonart geht es weiter. So werden genaue Daten zu Verstorbenen – ob „an“ oder „mit“ Covid-19 – sowie zu Hospitalisierungen und zum Alter der Betroffenen eingefordert. Außerdem will der VfGH wissen, welche Virusvarianten am 1. Jänner 2022, am 25. Jänner und tagesaktuell zu welchen Prozentsätzen bei Infizierten, Hospitalisierten und Verstorbenen vertreten waren. Und auch die „prozentuelle Zuordnung von stattfindender Infektion auf Lebensbereiche“, also etwa Familie, Arbeit, Einkauf und Freizeitbeschäftigungen, wird vom Ministerium abgefragt.
Auch diverse Schutzmaßnahmen im Fokus
Tatsachen fordert der Verfassungsgerichtshof auch zu den diversen verordneten Schutzmaßnahmen ein. So lautet eine weitere Frage: „Um welchen Faktor reduziert das Tragen einer FFP2-Maske in geschlossenen Räumen bzw. im Freien das Ansteckungs- bzw. Übertragungsrisiko?“ Und: „Um welchen Faktor verringert die COVID-Schutzimpfung das Risiko schwerer Verläufe?“ Weitere Fragen zur Wirksamkeit der Impfung folgen, aber auch zu den unterschiedlichen Tests.
Die letzten Fragen beziehen sich auf den „Lockdown für Ungeimpfte“ und inwieweit dieser Auswirkungen auf die Hospitalisierungen bzw. das Hospitalisierungsrisiko hat. Nur zwei Tage nach der Übermittlung der Fragen wurde diese Maßnahme von der Regierung aufgehoben.
